Accessing your Information

The Mental Health Review Tribunal recognises the right of individuals to access their own personal information and other documents held by the Tribunal that are relevant to a hearing.

Under the Mental Health Act 2000 patients must be notified of hearings and be given a copy of the decision of a hearing. If you have lost your copy of notices or decisions, you may ask the Tribunal for another copy.

If you wish to see a report written by your treating team that was before the Tribunal at a review, you should ask your treating team. Any document that the Tribunal considers during a person's hearing should be made available to you prior to the review. The treating psychiatrist or a member of the treating team should discuss the report that will be before the Tribunal during the hearing with the patient.

Exceptions

If there is a request for a Confidentiality Order, or if the Tribunal makes a confidentiality order, a patient will not be able access this information.

    The Tribunal is continuing its effort to make hearings more accessible to Indigenous patients by holding hearings in culturally-suitable venues and involving Indigenous Tribunal members whenever possible.
